Understanding the contract process

As a first time buyer, you’re caught up in finding the right property. You may not have thought much about the process after exchange of contract. More often than not, we find first home buyers are ready to exchange before they even start looking for a conveyancer.

Exchanging contracts can feel like the end of a long process, like you can finally relax. But there’s a lot to do between exchange and settlement. Property searches. Contract review and negotiation. Liaison with your bank or mortgage broker. Adjustments for items like water and council rates. Arranging pre-settlement inspection and of course the settlement date and time.

At Contract Conveyancing, we’re with you every step of the way. We work with you, step by step, to make everything happen smoothly.

The contract review is the most important stage. We’ll send you a single contract review document, which covers all issues.

In most cases, we’ll give you a couple of days to digest it, then arrange a time to go through the review with you. There are always some issues – it could be as simple as a missing sewer service diagram. That’s something we’d spot but most first home buyers wouldn’t. We advise you on all your options for each and take your instruction as to what you want to do.

On occasion, we find a major issue such as unapproved alterations. In this case, we contact you immediately. As conveyancers it’s always part of our job to spot red flags and put the brakes on until you can investigate, but it’s even more important when we’re acting for first home buyers. You may be investing your life savings. You probably don’t have a spare $50,000 to fix the situation, or many options to refinance.

If we can see a potential risk of additional costs in the future, we’ll let you know right away. Otherwise, we’ll work through the process step by step. The process of buying property can be overwhelming if you’ve never done it before, but we break it down into stages to make it easier for you.

Buying your first home is more than just contracts

We’re also here to assist and advise with the non-contractual parts of buying your first home. If you’ve never moved out on your own before you may have questions about:

  • Setting up electricity and other utility accounts
  • How to deal with strata and strata payments
  • The logistics of the move itself– whether you need a truck or removalist; whether you can move in a day early, and so on

While these issues are strictly speaking outside the conveyancing process, we want you to be as happy and confident on settlement day as you were when you exchanged contracts. So we’ll advise, support and where relevant refer you to trusted partners so that you can still taste the dream when you move into your new home.
